These Terms & Conditions (“Terms”) govern all purchases made through our website and form a legally binding agreement between you (“the Customer”) and Gemex Trading Ltd (“we”, “our”, “us”). By placing an order, you acknowledge and agree to be bound by these Terms.

1. Orders

• Made-to-Order Policy: All jewellery is crafted to order. Once an order is confirmed and production has commenced, cancellations are not permitted.
• Bespoke/Customised Items: All bespoke, customised, resized, or engraved items are final, non-cancellable, and non-returnable.
• Order Acceptance: Submission of an order constitutes an offer to purchase. We may accept or decline any order at our sole discretion. A binding contract is formed only once we confirm acceptance in writing (email) and production begins.

2. Eligibility

• You confirm you are at least 18 years old and legally capable of entering into binding contracts.

3. Right to Cancel by Us

We may cancel or refuse any order prior to dispatch if:

• Payment is not authorised or fraudulent activity is suspected;
• Required materials are unavailable or subject to production constraints; or
• Errors or inaccuracies are identified in pricing or product descriptions.

If we cancel, any payment received will be refunded in full.

4. Pricing & Payment

• All prices are in GBP (£) and reflect prevailing precious metal and gemstone market rates. Prices may change without notice.
• Payment must be made in full at the time of order.
• We accept major credit/debit cards and secure online payments. Title to goods passes only once payment has cleared in full.

5. Product Descriptions & Variations

• We take reasonable care to ensure descriptions, images, and specifications are accurate. Due to the nature of precious metals and gemstones, variations in weight, colour, clarity, and appearance may occur within accepted industry tolerances (up to one or two grading levels). Such variations are not defects.
• Weights and measurements are approximate and for guidance only.

6. Shipping & Delivery

• We ship worldwide. All shipments are insured up to the point of delivery.
• Delivery timeframes are estimates. We are not liable for delays caused by couriers, customs, or events beyond our control.
• Risk passes to you upon confirmed delivery.

7. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, extreme weather, acts of God, war, terrorism, strikes, labour disputes, governmental action, epidemics, transport interruptions, or customs delays.

8. Returns & Faulty Goods

• Strict No-Returns Policy: Because every piece is made to order, we do not accept returns or exchanges under any circumstances, unless the item is faulty due to a manufacturing defect.
• Size Responsibility: Sizing varies between manufacturers. If you are unsure about your size, please check with us before ordering. Customers are responsible for providing accurate sizes; incorrect sizing provided by the customer is not a fault and is not eligible for return, refund, or exchange.
• Faulty Goods Resolution: In the unlikely event of a proven manufacturing defect, we will, at our discretion, repair or replace the item. A refund will only be issued if repair or replacement is not possible.
• Exclusions: Faults do not include normal wear and tear, damage from misuse/neglect/unauthorised repairs, or variations within accepted industry tolerances.

9. Liability

• Our total liability is limited to the purchase price of the item.
• We are not liable for indirect or consequential losses, including emotional distress, loss of profits, or missed occasions.
• Nothing excludes liability for death or personal injury caused by our negligence, fraud, or other liability that cannot be excluded by law.
