These Terms & Conditions govern all sales by Xclusive Diamonds Ltd. Please read them carefully before placing an order. By proceeding with a purchase, you agree to be legally bound by these Terms.
These Terms apply to all orders placed online, remotely, or otherwise. No other terms shall apply unless agreed in writing by Xclusive Diamonds.
By placing an order, you confirm that you are at least 18 years old and legally capable of entering into a binding contract.
All jewellery sold by Xclusive Diamonds is made to order and/or personalised, including but not limited to:
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, made-to-order and personalised goods are exempt from the standard 14-day cancellation right. By placing an order, you expressly acknowledge and agree to this exemption.
Orders are accepted only once payment has cleared in full and an order confirmation has been issued. We reserve the right to refuse or cancel any order prior to production
By completing checkout, the customer confirms that they have reviewed and accepted the Shipping & Returns Policy and acknowledges that all goods are made to order and non-returnable, except where required by law.
All prices are listed in GBP (£). Full payment is required before production begins. We reserve the right to withdraw products or correct pricing errors.
Production is deemed to have commenced once materials are allocated, manufacturing begins, diamonds are sourced, or third-party services are engaged.
Orders may only be cancelled before production has started. Once production has commenced, cancellation is not permitted under any circumstances except where required by law.
Delivery times are estimates only. Risk passes to the customer upon confirmed delivery. Signature may be required. We are not responsible for delays caused by couriers.
Title to goods passes only once full payment has been received and any return inspection (if applicable) has been completed.
There is no automatic right to return made-to-order jewellery. Returns are accepted only at our discretion and subject to strict compliance with our Returns Policy.
To be considered for return, all of the following must be met:
Failure to meet any condition results in rejection.
All returned items undergo professional inspection. Xclusive Diamonds has sole authority to determine wear, damage, misuse, or fault. Our decision is final.
Any jewellery showing signs of wear, however minor, is deemed accepted by the customer and is strictly non-returnable and non-refundable.
Approved returns are subject to a fixed 25% restocking and administration fee. Original delivery charges are non-refundable.
Any resizing, engraving, polishing, or specification change renders the item strictly non-returnable and non-refundable, except where a genuine manufacturing fault exists.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. Where a genuine manufacturing fault is confirmed, we may repair, replace, or refund at our discretion.
The following do not constitute faults:
We reserve the right to refuse returns, restrict future purchases, or recover costs where misuse, fraud, or abuse of our policies is suspected.
By placing an order, you agree that any chargeback raised contrary to these Terms constitutes a breach of contract. We reserve the right to dispute chargebacks using all available evidence.
All website content, imagery, designs, and trademarks remain the property of Xclusive Diamonds. Unauthorised use is prohibited.
To the fullest extent permitted by law, our liability is limited to the purchase price of the item. We are not liable for indirect, consequential, or economic losses.
We are not liable for delays or failures caused by events beyond our reasonable control.
If any provision is found unenforceable, the remaining provisions shall remain in full force.
We reserve the right to amend these Terms at any time. The version in force at the time of order shall apply.
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
